The following terminology applies to these Terms and Conditions,
Privacy Statement and Disclaimer Notice and any or all Agreements:
"Client", “You” and “Your”
refers to you, the person accessing this website and accepting
the Company’s terms and conditions. "The Company",
“Ourselves”, “We” and "Us",
refers to our Company. “Party”, “Parties”,
or “Us”, refers to both the Client and ourselves,
or either the Client or ourselves. All terms refer to the
offer, acceptance and consideration of payment necessary
to undertake the process of our assistance to the Client
in the most appropriate manner, whether by communications
of a fixed or non-fixed duration, or any other means, for
the express purpose of meeting the Client’s needs
in respect of provision of the Company’s stated services/products,
in accordance with and subject to, prevailing US Law. Any
use of the above terminology or other words in the singular,
plural, capitalization and/or he/she or they, are taken
as interchangeable and therefore as referring to same.
1.Privacy
1.1 We will use the information you provided to us to communicate
with you regarding your order. This may include sending
you your invoice, tracking number, order status and answers
to your questions through email, telephone or mail. We will
not use your information for any other reason except for
this transaction. We will not release your information to
any third parties if the purpose is not to fulfill and complete
your transaction. In other words, your information is safeguarded
to our standards.
2.Payment
2.1 We accept credit cards, debit cards, gift cards, reloadable
cards, personal checks, company checks, cashier's checks,
money orders, wire transfers and PayPal as acceptable payment
methods. We safeguard all sensitive payment information
and will destroy all payment information once the transaction
is complete and is no longer needed for our records. We
comply with Merchant Bank standards and operate in accordance
to this. Once the transaction is completed in its entirety,
your information will be erased from our servers to protect
and safeguard the information.
3.Order Cancellations
3.1 You may cancel your order if it has not yet been processed.
We process orders multiple times a day, so if you choose
to request cancellation, please call us at our Toll Free
Number immediately or email us directly during non-telephone
hours. Order cancellations will be honored only when there
is a cancellation confirmation from us. If your order has
already been processed, you may not make any further changes
to your order.
3.2 If your product(s) somehow cannot be delivered (undeliverable)
or if delivery is refused by the recipient, you agree to
all transit costs incurred to have the product shipped to
you and the cost of the product being returned to us along
with a 25% restocking fee being charged on the item(s) arriving
back to our warehouse, if delivery was unsuccessful. Transit
costs may or may not be the exact amount that was paid for
when the order was placed. This is due to some promotional
offerings we may have had at the time of your purchase.
Actual transit costs will be used in that calculation.
4.Product Liability
4.1 The vehicles we sell are all gasoline powered vehicles.
While many adults ride these vehicles, minors may ride these
vehicles as well. We recommend all of our customers treat
these vehicles not as toys, but as gasoline powered vehicles.
This means that all safety precautions must be taken before
proceeding to ride any vehicle. Full safety gear, a safety
check (ensuring bolts are tight, tire pressure is correct,
etc) and supervision (if applicable to minors) is strongly
recommended. By making this purchase, you agree that you
will not hold us liable for any consequences directly or
indirectly resulting from the use of these vehicles, parts
and / or accessories. It is the sole responsibility of the
purchaser to ensure the safety of the rider.
4.2 Because these vehicles are not toys, a common working
knowledge and ability from a mechanically inclined person
is strongly advised. This may be the purchaser themselves
or a friend or family member. Like an automobile, these
vehicles can last several years with the proper maintenance.
For example, worn tires can be replaced, spark plugs can
be changed, brake pads can be swapped out and damaged parts
can be replaced. However, the purchaser should have the
resources to perform necessary tasks to ensure years of
enjoyment out of your vehicle. We provide lifetime technical
support via our toll free telephone number for all of our
customers, and it will be our pleasure answering any questions
that may arise even years after your purchase.
5.Warranty
5.1 We offer toll-free technical support in addition to
our Quick Start Guide (under section Pocket Bike Usage)
and Owner's Manual. You may phone us anytime with any questions
or concerns during telephone hours, which is Monday - Friday
9:00am - 6:00pm, PST, excluding holidays. We also respond
to virtually all emails within 24 business hours. This measure
is to keep the lines of communications open between us and
our customers. Whether our customers need advice regarding
our products or are in need of help resolving any concerns
or questions that may arise before, during and after the
purchase. Our technical support team is dedicated in assisting
our customers for the life of the product. And this comes
free with any purchase made with our Company.
5.2 We warranty all products we sell for a period of 60
days from time and date of order. This warranty covers against
all manufacturer defects. We will, at our discretion, send
out replacement parts to cover those requested parts upon
the customer completing and signing our RMA form. A link
to our RMA form can be requested by email or can be found
publicly on our website under the FAQs section of our website.
We may require you to send in pictures to verify your claim
either by email or by mail. If the picture cannot clearly
depict the defect, we may require you to send in your part
for inspection. This warranty does not cover damages caused
by user error or user abuse. Because the items we sell are
comprised of many parts, specific parts can be sent out
to remedy any concern of manufacturer defects. You, or someone
you know, should have some basic skills in working with
these types of products. Because they are not merely toys,
parts can be changed out to remedy all types of claims.
Only basic tools are needed, and most replacement items
can be swapped out in a very short amount of time. For example,
if a foot peg on a pocket bike is deemed defective, a new
foot peg will be sent out to you completely free of charge
within your warranty period. This single part can be changed
out without the use of tools and will not warrant an entire
replacement bike being sent out. You agree to not hold us
liable for replacing the entire unit, and agree to parts
replacement as a Fair and Adequate compensation for defects.
5.3 Shipping damages, while rare, can occur when the courier
mishandles your item during the delivery process. All items
shipped from us are fully insured, so you are always covered
in these rare instances. If this is the case, you will need
to contact us via telephone or email within five (5) days
of delivery date to have your issue resolved. We may, at
our sole discretion, and depending on the extent of the
damage, file an insurance claim with the carrier or send
out replacement parts to you free of charge. For example,
if the plastic windshield arrived cracked during shipping,
we will send that part out to you free of charge. We may
require you to send in pictures to verify your claim either
by email or by mail. If the picture cannot clearly depict
the damage, we may require you to send in your part for
inspection. You will then proceed to replace the windshield
with the use of common tools, most of which are supplied
along with the vehicle, if applicable. If we deem the package
was grossly mishandled by the courier, we may elect to file
the insurance claim so that you may have a brand new item
shipped out to you at no extra cost or you may elect to
receive a full refund once the claim is approved. If an
insurance claim is filed, you agree to have the product
available for pickup by the courier for inspection. Otherwise,
you forfeit the right to the insurance claim, as the courier
will not have the opportunity to complete the claim. However,
in most instances and to speed up the process in remedying
the situation, we will send out the part to you free of
charge. This is the fastest and most efficient way to get
your product back to original condition . You agree to not
hold us liable for replacing the entire unit, and agree
to parts replacement as a Fair and Adequate compensation
for the damage.
6.Product Exchange
6.1 Product exchanges are to be handled on a case-by-case
basis. For example, if you ordered a helmet that is too
large, you may ship the item back for an exchange to a smaller
size. We will honor your request, based on availability,
and ship out a smaller helmet at no extra cost to you. For
vehicles, once it has been ridden and / or used or gasoline
has been filled, the sale then becomes final, as we cannot
accept used merchandise that is in non-resellable condition.
In order to qualify your item for exchange, an RMA number
needs to be issued by us. You may request an RMA number
within the 30 day exchange window.
7.Product Refunds
7.1 Product refunds are to be made within 30 days from order
date. Once the 30 day window has passed, the sale then becomes
final. If you choose to return the item, it must be returned
in unused, resalable condition and in its original packaging.
Shipping costs to have the item sent to you is non-refundable
and the buyer is responsible for shipping the unused item
back to us. Upon clearing inspection, a refund will be issued
less a 25% restocking fee of the purchase price. Your RMA
Number is the original 6 or 7 digit invoice number on your
receipt when you initially made the purchase.
Product(s) must be returned before any refund is given.
Please use a courier service that provides a tracking number.
You may need to furnish this upon request. Please allow
a minimum of 7 days after we receive the item(s) for the
refund to process.
